Law no. 37/2007, of August 14 Protection of citizens from involuntary exposure to tobacco smokeLaw No. 37/2007, of August 14, prohibits smoking in establishments where accommodation services are provided and in any other place where, by determination of the management, or other applicable legislation, smoking is prohibited. The provisions apply to the use of new smokeless tobacco products that produce inhalable aerosols, vapors, gases or particles, and electronic cigarettes with nicotine, that is, products that can be used to consume vapor through a mouthpiece, and that contain nicotine or any component of that product. It is up to the entities that manage these spaces to ensure compliance with the provisions of the Law. These entities must intervene directly when they verify an infraction, ordering the smoker to refrain from smoking. If this is not done, they must call the competent authorities. Furthermore, anyone using these spaces has the right to demand compliance with the law, and may even file a formal complaint, for example, through the complaints book. The infractions are considered minor offenses, punishable by a fine of 150 to 500 euros, applicable to those who smoke in prohibited areas. |
